• We reserve the right to refuse service or cancel work orders in certain circumstances

User Responsibilities

When using our services, you agree to:

• Provide Accurate Information: Supply truthful and accurate details about your vehicle, the damage, and your contact information
• Authorization: Confirm that you are authorized to approve repairs on the vehicle you bring to us
• Timely Payment: Pay for services in accordance with the agreed-upon terms and schedule
• Vehicle Pickup: Retrieve your vehicle within the agreed timeframe after repairs are completed
• Remove Personal Items: Remove all personal belongings from your vehicle before service (we are not responsible for items left in vehicles)
• Insurance Cooperation: If filing an insurance claim, cooperate with the claims process and provide necessary documentation

Liability Limitations

To the fullest extent permitted by law:

• Personal Items: Ken's Body & Paint is not responsible for personal items, valuables, or accessories left in vehicles. Please remove all personal belongings before service.
• Storage Fees: Vehicles not picked up within 10 days of completion notification may be subject to daily storage fees
• Insurance Claims: While we provide assistance with insurance claims, we are not responsible for claim denials, coverage limitations, or disputes between you and your insurance company
• Force Majeure: We are not liable for delays or failures in performance caused by circumstances beyond our reasonable control, including natural disasters, supplier delays, or parts shortages
• Pre-existing Conditions: We are not responsible for pre-existing damage or mechanical issues not related to the authorized repair work

Warranty Terms:

• Lifetime warranty on paint workmanship (original owner, normal use conditions)
• Specific warranty terms vary by repair type and will be provided in writing
• Warranties do not cover damage from accidents, abuse, or normal wear and tear
• All warranty claims must be presented in a timely manner with proper documentation

• We reserve the right to retain vehicles until payment is received in full (mechanic's lien)

In the event of any dispute arising from these Terms or our services:

• Governing Law: These Terms are governed by the laws of the State of Oregon, without regard to conflict of law principles
• Jurisdiction: Any legal action must be brought in the appropriate courts of Klamath County, Oregon
• Good Faith Resolution: We encourage customers to contact us directly to resolve any concerns before pursuing legal action
• Informal Resolution: Most disputes can be resolved through good-faith communication and negotiation

Limitation of Liability

To the maximum extent permitted by law, Ken's Body & Paint shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services or website.
